GENERAL PROVISIONS

1.1

These General Terms of Use of the website and the Web Store service regulate the use of the website by users, as well as the use of the Web Store service.

1.2

In these General Terms, the terms written in bold have the following meanings:

Vučko Trail, owned by the Mountaineering Association Planinarsko društvo Željezničar, based in Sarajevo, Ključka 2, registered in the register of associations of the Ministry of Justice of Sarajevo Canton.

Website refers to all web or internet pages owned by Vučko Trail.

User means any natural person who accesses the website. The term “user” also includes online customers.

Online customer means any fully legally competent person, legal or natural, who makes an online purchase on the website.

Web Store is a service that enables customers to purchase Vučko Trail products or services via the website.

1.3

By accessing the website through an appropriate technical device and using it, every customer agrees to comply with these General Terms and accepts that the provisions of these General Terms apply to them.

RESTRICTIONS ON USE AND LIABILITY

2.1

The user undertakes not to:

  • use the website in any manner contrary to applicable regulations;

  • upload or distribute on the website any content that is contrary to applicable regulations, including but not limited to harmful, threatening, harassing, vulgar, pornographic content, content that spreads hatred or racial intolerance, content that infringes the rights or interests of others, etc.;

  • alter, delete, or destroy any data on the website;

  • use the website to violate the rights of third parties, including breaches of confidentiality, intellectual property rights, or other rights or interests of third parties;

  • use the website to send emails contrary to these General Terms;

  • upload or distribute any illegal or malicious software via the website.

2.2

Documents, data, and information published on the website may not be reproduced, distributed, or used in any commercial manner without the express consent of Vučko Trail, nor in any way that could cause harm to Vučko Trail or any third party. Such content may be used only for the user’s personal needs, respecting all copyright and ownership rights.

2.3

By using the contents of the website, the user accepts all risks arising from its use and agrees to use the website content solely for personal purposes and at their own responsibility.

2.4

Vučko Trail fully disclaims any liability:
(i) arising in any way from or related to the use of the website,
(ii) for any actions of users in relation to the use or misuse of website content, and
(iii) for any damages that may occur to the user or any third party in connection with the use or misuse of website content.

2.5

The website contains documents, data, information, and links to other websites created by third parties. Vučko Trail has no control over such content and disclaims any liability, including but not limited to accuracy, completeness, and availability of content on third-party websites. Vučko Trail bears no responsibility for any content displayed on such third-party websites or for any products or services obtained through them.

2.6

Vučko Trail reserves the right to modify the website content, discontinue the website, or restrict access without prior notice, and shall not be liable for any consequences arising from such changes.

2.7

Vučko Trail shall not be liable for any consequences arising from website unavailability due to technical issues.

2.8

Vučko Trail reserves the right to change the prices of its services or products.

2.9

Vučko Trail reserves the right to block access to the website and IP addresses from which actions contrary to these General Terms are performed, without assuming any liability.

2.10

Vučko Trail is in no way responsible for any costs users incur in connection with the use of computer equipment or telecommunications systems for accessing the website or the Web Store service.

INTELLECTUAL PROPERTY

3.1

The user acknowledges that all website content is the exclusive property of Vučko Trail or its licensors.

3.2

By using the website, the user is granted a limited, non-exclusive, non-transferable, revocable license to use the content solely for personal purposes.

3.3

Vučko Trail expressly retains all rights to the website content which are not granted to the user under these General Terms.

3.4

Users do not have the right to download, reproduce, modify, edit, distribute, display, delete, send, sell, resell, adapt, alter, create derivative works from, embed into other websites or media, or otherwise use the content except for personal, non-commercial use.

3.5

If explicitly permitted, the user may download certain content and undertakes to use it solely for personal purposes while respecting all provisions of these General Terms.

3.6

By uploading any content (including photos) to the website, such content becomes the exclusive property of Vučko Trail.

PERSONAL DATA PROTECTION

4.1

Before accessing certain content, users may be required to provide their personal data to Vučko Trail. By agreeing to provide personal data, users are considered to have accepted the terms of use of personal data set out in these General Terms, based on which certain persons are granted the right to collect, use, process, and transfer personal data necessary for the use of the website.

4.2

By ticking the appropriate checkbox on the website, the user is deemed to consent to the collection, use, processing, and transfer of personal data necessary for the use of the website, including but not limited to:

  • consent that Vučko Trail may, in accordance with the Personal Data Protection Act, process the provided personal data for the needs of its own records and the provision of services, for creating a customer database, notifying users about new products and services, and improving its services, and that Vučko Trail may share such data with third parties for the purpose of service delivery, protecting user interests, and preventing misuse;

  • the need for better insight and understanding of individual user needs and requests, as well as developing the ability to provide the highest quality service to the satisfaction of users;

  • providing data to other persons necessary for fulfilling the above purposes.

4.3

Vučko Trail will retain personal data only for as long as necessary for the purposes set out in these General Terms. After this period, personal data will be destroyed, deleted, or anonymized in a manner that ensures the continued security of personal data.

4.4

Vučko Trail will not disclose personal data to third parties except to entities within its group of companies.

4.5

Vučko Trail will ensure that personal data is stored in a secure location (including reasonable administrative, technical, and physical safeguards to prevent unauthorized use, access, disclosure, copying, or modification of personal data), accessible only to authorized persons.

4.6

Vučko Trail will allow users access to their personal data in its possession in order to ensure that such data is accurate, complete, and up to date.

4.7

If users have any questions regarding the use of personal data, they may contact Vučko Trail directly.

4.8

If users request the deletion of their personal data, Vučko Trail will remove such data; however, users accept that this may limit or disable their access to certain website content.

4.9

When providing personal data, the user guarantees that such data is complete, truthful, accurate, and up to date.

USE OF THE WEB STORE SERVICE

5.1

Use of the Web Store service is available to users who are of legal age and fully legally competent, which they confirm by using the Web Store service.

5.2

Orders for services or products are placed electronically. A service or product is considered ordered once the customer completes the entire ordering process. A confirmation that the order has been received will be sent to the email address provided at the time of purchase.

5.3

If Vučko Trail is unable to deliver a requested service or product, it will contact the customer by telephone or email. The customer may cancel the item or request a replacement.

PRICES OF PRODUCTS THROUGH THE WEB STORE SERVICE

6.1

Product prices are expressed in convertible marks (BAM) and include VAT. Vučko Trail may offer certain discounts applicable for a specific period.

6.2

Product prices are subject to change until the moment of purchase confirmation.

6.3

By confirming the purchase, the online customer completes the purchasing process. The sales contract is concluded at the moment payment is received.

METHODS OF PAYMENT THROUGH THE WEB STORE SERVICE

7.1

Online customers may pay for products using payment cards or after delivery, i.e., upon receipt (cash on delivery).

DELIVERY THROUGH THE WEB STORE SERVICE

8.1

Delivery of services and products is available only within Bosnia and Herzegovina.

8.2

Once Vučko Trail registers the order (within a maximum of 48 hours), the product or service will be delivered within 3 to 45 working days within BiH, depending on the type of service or product.

8.3

If the online customer cannot be reached using the provided contact number, Vučko Trail is not responsible for any delay in delivery.

8.4

The order will be delivered to the specified address. If the customer is not available:

  • a notice with a contact number will be left, or

  • the product may be received by another person (an adult household member or an authorized representative) upon presenting identification.

8.5

Upon receiving the shipment, the online customer must inspect it; visible damage must be reported directly to the courier, and the damaged shipment must be refused. By signing the delivery note, the customer confirms that the product has been checked.

If the customer refuses the package due to visible damage, they must fill out the courier’s form and notify Vučko Trail. After receiving the returned package, Vučko Trail will resend the item within 5 working days (if available), or order a new one without extra cost, or refund the customer.

8.6

If the customer does not pick up the product or refuses it without valid reason, Vučko Trail reserves the right to claim reimbursement of incurred costs.

COMPLAINTS AND RETURNS THROUGH THE WEB STORE

9.1

The customer has the right to file a complaint or return a product within 15 calendar days if it arrives damaged, incomplete, or not corresponding to its description. Vučko Trail will refund the customer or replace the product within 30 days of receiving the returned item. Complaints after 15 days will not be considered. Refund rules for purchased services (e.g., race registration fees) follow the Vučko Trail Race Rulebook.

9.2

The right to withdraw does not apply to custom-made products.

9.3

The customer may withdraw from the contract by sending a written notice to the designated address or email info@vuckotrail.ba. The deadline is considered met if the notice is sent before the last day of the 15-day period.

9.4

The customer is responsible for any decrease in product value resulting from handling beyond what is necessary to determine the nature and functionality of the product. This includes returning any product:

  • not in original packaging,

  • missing items included in delivery,

  • with removed labels or protective features, etc.

9.5

Refunds under section 9.1 may be reduced for:

(a) extra delivery costs if the customer selected a more expensive form of delivery;
(b) diminished product value per section 9.4.

9.6

If the customer withdraws from the contract legally, all related ancillary contracts also become void.

9.7

If the complaint is justified, Vučko Trail will bear the cost of resending the product.

9.8

If the wrong product was delivered, the customer must report it within 3 days. Vučko Trail will send the correct product or issue a refund within 3 days after receiving the incorrect item.

9.9

If the customer did not receive the ordered and paid product, they must report it within 3 days from the expected delivery date. Vučko Trail must investigate and inform the customer of the outcome.

OTHER CONDITIONS OF THE WEB STORE SERVICE

10.1

Vučko Trail is not liable for damages resulting from:

  • unauthorized use of personal data,

  • misuse of the Web Store service, unless caused by Vučko Trail’s fault.

10.2

Vučko Trail is not liable for any damage caused by interruptions in internet connectivity during use of the Web Store service.

AMENDMENTS TO THE GENERAL TERMS AND OTHER PROVISIONS

11.1

Vučko Trail reserves the right to amend these General Terms without prior notice. Online customers must review the applicable General Terms each time they use the website or Web Store. The currently valid Terms will be published on the website.

11.2

For use of the Web Store service, the applicable General Terms are those in force at the moment Vučko Trail receives the order.
